Tea Act, 2020. Act no. 23 of 2020.

This Act, consisting of 81 articles and divided into ten parts, concerns the regulation, development and promotion of the tea industry and the connected purposes.
Part I concerns interpretation of relevant terms, including: commercial green leaf transporter, as a person, a firm or a corporate body contracted by a tea factory to provide green leaf transport services; crops inspector; tea, means the plant botanically known as camellia sinensis and includes its seed, tea plants and the leaf, whether on the plant or detached therefrom, and in the latter case, whether green tea or manufactured tea. Part II establishes the Tea Board of Kenya, defines its functions, powers and the authority appointed by the Board. Among its duties, the Board shall develop, promote and regulate the development of the tea industry; regulate sale, import and export of tea.
Part III concerns the role and the powers of national and county governments in the development of tea, including the development of tea grown within the county; tea disease and pest control; soil and water conservation; issue of licenses and registration of various operators. Part IV concerns the appointment of crop inspectors and the definition of their powers.
Part V provides for the establishment of a tea levy on imports and a tea fund in order to stabilize prices. Part VI establishes the Tea Research Foundation, as a corporate body empowered to promote, co-ordinate and regulate research in tea and tea diseases. Part VII concerns financial provisions. Part VIII concerns complaints and investigation procedure. Part IX concerns miscellaneous provisions, including general penalties. Part X concerns final provisions.
