Water Services Regulations - Legal Notice no. 168/2021.

These Regulations implement provisions of the Water Act, no. 43 of 2016 concerning networks, facilities, equipment, applications and assets for water production, transmission, distribution and waste water and any other services necessary to the supply or storage of water and disposal of waste water. The Regulations shall apply to the National Government, its entities, county governments, its entities and any other person providing water services.
Matters covered by the Regulations include: interpretation of relevant terms, including: sewerage services, trade effluent, water services; Powers and duties of county executive committee member for water services; establishment, operation and financing of water services providers; issue of licences and permits; implementation of standards and systems for operation of water services, including schedule of water supply and sampling the quality of potable water; effluent and wastewater disposal systems; implementation of tariffs by water service provider; clustering of water service providers; bulk water supply services; fees, levies and administration of water supply services; inspection, evaluation and monitoring; complaint mechanism and engagement with consumer and water action groups; enforcement actions; general offences and penalties.
