Abstract
This Act provides for protection, conservation and management of wildlife in Kenya and related matters. The 68 sections of this Act are divided into 9 Parts: Preliminary (I); Administration (II); National Parks, National Reserves and Local Sanctuaries (III); Control of hunting (IV); Trophies and live animals (V); Enforcement (VI); The Wildlife Fund (VII); General Provisions as to officers, etc. of the Service (VIII); Miscellaneous (IX).
Section 3 provides for the establishment of a Wildlife Conservation and Management Service ("The Service") as a Department of the Government. The Minister, after consultation with the competent authority as defined in section 2, may, by Order, declare any area of land to be a National Park (sec.6). National Parks shall be managed and maintained by the Director of Wildlife Conservation and Management (sect. 9). The Minister may, after consultation respectively agreement with the competent authorities, declare National Reserves, Local Sanctuaries, and Protection Areas (sects. 15, 18, and 19). Protection areas are areas adjacent to a National Park, a National Reserve, or a Local sanctuary, and are established for the purposes of protection of fauna and flora in such areas. Provisions of Part IV regulate game licences, game registers to be kept by each holder of a licence, special authorisation to hunt, hunting on private land, hunting in general, and close seasons. The Act is completed by 4 Schedules: Game animals within the meaning of section 2(1); Game birds within the meaning of section 2(2); Protected animals (3); Transitional provisions under section 68 (4)).
