Abstract
This Law shall govern both economic and moral relations arising out of creation (discovery, development), legal protection and use of selection achievements for which patents have been granted in the Kyrgyz republic. This Law shall apply to genera and species the list of which shall be approved by the Government. The Act consists of 11 Sections composed of 40 articles. Section 1 lays down the general provisions. Section 2 determines the conditions of patentability of selection achievements and the procedure for filing applications for the grant of patent. Section 3 regards examination of selection achievements. Section 4 concerns registration of selection achievements and the grant of patent. Section 5 deals with the rights of an author of a selection achievement. Section 6 regards rights and obligations of patent owners. Section 7 regards defence of the rights of patent owners. Section 8 regards revocation and cancellation of patents. Section 9 deals with licences. Section 10 deals with international cooperation. Section 11 lays down final provisions.
