Abstract
This Law regulates property, as well as related personal non-property relations, arising on the territory of the Kyrgyz Republic in connection with the creation, legal protection and use of inventions, utility models and industrial designs. The authorized state body of the Kyrgyz Republic in the field of intellectual property, in accordance with this Law, implements a unified state policy in the field of providing legal protection to inventions, utility models, industrial designs, accepts applications for inventions, utility models and industrial designs, conducts their examination, state registration, issues patents, carries out official publication and other functions in accordance with the regulations approved by the Cabinet of Ministers. The authorized state body manages the patent fund, ensures its storage and acquisition through exchange with international organizations and foreign patent offices. Rights to inventions, utility models and industrial designs are regulated by this Law and are confirmed by a patent, which certifies the priority, authorship and exclusive right of the patent owner. A patent for an invention is valid for 20 years, counting from the date of filing the application with the authorized state body. A patent for a utility model is valid for 10 years, counting from the date of filing the application with the authorized state body. A patent for an industrial design is valid for 5 years from the date of filing the application with the authorized state body. A technical solution in any field related to a product (in particular a device, substance, microorganism strain, plant and animal cell culture) or method (the process of performing actions on a material object using material means), including the use of a product, is protected as an invention or a method for its new purpose. An invention is industrially applicable if it can be used in industry, agriculture, healthcare and other sectors of the economy. Plant varieties and animal breeds shall not be considered inventions. Any person who is not the owner of a patent has the right to use an invention, utility model, or industrial design protected by a patent with the permission of the patent owner on the basis of a license agreement.
