Abstract
The Order approves the Charter of the state enterprise “Eco Operator” created under the Ministry. The attached Charter sets out the legal and economic foundations of the enterprise’s activities, its status as a state enterprise under the Ministry, its legal personality, interaction with other state bodies and entities, and the targeted nature of its funds, which are accumulated in the national budget. The Charter defines the main purpose of Eco Operator as accumulating funds and implementing modern economic regulation mechanisms to form and manage a comprehensive system for handling waste from the use of goods and packaging suitable for further processing. It aims to prevent harmful impacts of such waste on human health and the environment, return waste into economic circulation as secondary raw materials, use waste for new products and energy generation, and ensure operation of environmental information systems financed from utilization of fee revenues. The Charter sets objectives including efficient use of utilization fee funds, attracting domestic and foreign investment, financing projects aligned with the Charter’s goals, supporting separate waste collection systems, developing and modernizing information systems on waste and packaging, and increasing transparency and efficiency of the utilization fee system. Functions include processing project applications and submitting them to a Supervisory Board, financing and monitoring projects, maintaining a register of recyclers, participating in state programs and legislative improvement in waste management, conducting educational and outreach activities, engaging in concessions and public private partnerships, operating information systems and registers, receiving declarations and reports from payers, and controlling calculation and payment of the utilization fee. The Charter further regulates the rights and obligations of the enterprise, including the right to open bank accounts, conclude civil law contracts, conduct income generating activities to achieve its goals, place temporarily free funds on short term deposits, and act as customer or operator for information systems. It establishes governance through a Director and a collegial Supervisory Board that oversees targeted use of funds, with detailed rules on appointment, dismissal, and incompatibilities for management. The Director’s powers cover overall financial and economic management, budget planning and reporting, personnel management, internal regulations, and representation of the enterprise. The Charter also sets rules on budgeting (based on utilization fees, grants and other lawful sources), accounting and reporting in line with national legislation, publication of quarterly financial reports on the official website, and the procedure for reorganization and liquidation by decision of the Cabinet of Ministers or a court, including handling of property and documents in accordance with the Civil Code and archival legislation.
