Abstract
The Rules define key terms (unit of immovable property, cadastral plan, technical passport, registration zone, automated registration system, beneficiary right, etc.) and establish the structure and content of the Unified State Register of Rights (EGRP), including its paper and electronic components and the integration of local databases into a national real estate information system.
The Rules set out in detail the procedures for mandatory registration of specified real rights and encumbrances (ownership, economic management, operational management, pledge, long-term lease, servitudes, nature-use rights, perpetual use, rights arising from court decisions and others). They regulate submission, form and content of applications and supporting documents, including identity documents, powers of attorney, technical documentation and electronic documents signed with digital signatures. They prescribe time limits for registration (generally three working days, one day for subsequent transactions), grounds and procedures for refusal to accept documents or to register rights, and the calculation of penalties for late submission.
Extensive provisions govern cadastral surveying, preparation of cadastral plans, coding and mapping of real estate units, and the division and consolidation of parcels. The Rules specify who may obtain which categories of information (including free access for courts, enforcement and supervisory bodies), the forms of extracts and certificates, and restrictions on access to aggregated data and transaction details. They also regulate internal journals, responsibilities of registrars and archivists, security and fire safety requirements for archive premises, and the issuance of duplicates and repeated certification inscriptions. Overall, the document establishes a detailed procedural and technical framework for secure, unified and largely digitized registration of real property rights and related transactions across the country.
