Order No. 329-ni of the Ministry of Agriculture validating the Procedure for allotment of agricultural land of the State Agricultural Land Fund.

This Procedure for allotment of lands of the State Agricultural Land Fund to seed-growing, breeding farms, agricultural cooperatives and economically priority agricultural entities. This Procedure is aimed at ensuring a unified state policy in the field of allotment of agricultural lands of the state fund of agricultural land to seed-growing, breeding farms, agricultural cooperatives and economically priority agricultural entities, transferred in the prescribed manner for perpetual (open-ended) use to the authorized state body in the field of agriculture, provided by the direct allotment method. The land of the State Fund can be allotted to seed-growing and breeding farms for a period of 5 years; after the expiration of the contract, the tenant has, other things being equal, a preferential right over other persons to conclude a lease agreement for a new period of 15 years. The lease agreement includes: (a) intended use; (b) terms of use; (c) rights and obligations of the parties to the contract; (d) investment contribution to increasing the productivity of the allotted land; (e) rent for the use of land; (f) force majeure circumstances; (g) types of proposed crops, taking into account natural and climatic conditions; and (h) other obligations that do not contradict the law.
