Abstract
This Law aims to protect the marks and trade names duly registered in the register of marks in the Kingdom of Cambodia and prevent the acts of unfair competition on the creation, the utilization of marks and trade names.
The exclusive right to a mark, as conferred by this Law, shall be acquired by registration in accordance with the provisions thereof, while trade names need no prior registration for protection. The Law empowers the Ministry of Commerce to maintain the register of marks and oversee related administrative functions. The Law further defines key terms, outlines registration procedures, and sets conditions under which marks may be refused or invalidated. It also addresses collective marks, licensing, and the rights of mark owners. In addition, it bans counterfeiting, imitation, misleading indications and other dishonest acts, with fines up to 20 million riels or 5 years’ prison.
