Abstract
The purpose of this Law is to promote and facilitate the implementation of privately financed in the Kingdom of Cambodia in order to ensure the public interest and the fulfillment of the national economic and social objectives.
A Concession shall be granted by a Concession Contract in accordance with the provisions of this Law, and its relating regulations. Concession Contracts in relation to Infrastructure Facility providing directly or indirectly services to the general public may be entered into by the relevant institutions in the sectors prescribed in Article 5, including: a- power generation, power transmission and power distribution; b- transportation facilities systems, including, but not limited to roads, bridges, airports, ports, railways, channel; c- water supply and sanitation; d- gas and oil related infrastructures; f- sewerage, drainage and dredging; g- irrigation and agricultural related infrastructure; h- waste management and treatment; etc.
The Council for Development of Cambodia is the one stop service entity for obtaining authorisations required to implement a Investment Project in accordance with the Law on Investment. The Contracting institution shall select the Concessionaire through international or national bidding procedures, by negotiated procedure according to the circumstances. The Law makes provisions, inter alia, for concession period termination, offences and penalties, etc.
