Abstract
This Law defines the principles, mechanisms, compensation and procedures for expropriation relating to construction, rehabilitation and expansion of public physical infrastructure in Cambodia.
The Law stipulates that only the State may expropriate property for the public benefit or state interest. An Expropriation Committee shall be established and headed by a representative from the Ministry of Economy and Finance, and other representatives from concerned ministries/institutions. According to Article 15 of Chapter 4 Expropriation Procedures, an expropriation shall be carried out based on the public physical infrastructure project and shall be approved in principle by the Royal Government. The Law further makes procisions for: payment of compensation for expropriation, dispute resolution, penalties, etc.
