Penal Code (Amendment) Act No. 3 of 2019.

Under section 44 of the Penal Code, the court has a discreation to suspend a sentence that is less than 2 years. This Act inserts Section 44A to give the court a mandate not to apply section 44 where a weapon was involved or used during the commission of an offence. The purpose of this amendment to prevent offences being committed with the used of involvement of a weapon.
