Abstract
This Act provides for the protection of geographical indications. The Act defines the following relevant terms: geographical indications, as indication which identifies any goods as originating in the territory of a country, or a region or locality in that territory, where a given quality, reputation or other characteristic of the good is essentially attributable to its geographical origin; good, any natural or agricultural products or any products of handicraft or industry; producer; spirits. The Act concerns: availability of protection regardless of registration; homonymous geographical indications for wines; exclusion from protection; application for registration and related procedures; right of use; proceedings for unlawful use of geographical indications; special provisions concerning marks; marks conflicting with a geographical indication for wines and spirits; offences.
