Abstract
This Act, consisting of 94 articles, divided into ten Parts, provides for the establishment of the Saint Christopher Air and Sea Ports Authority and defines its duties, responsibilities and functions. The Act defines: goods, as all kinds of movable property including animals; authorised officer; perishable goods, as fish, fruits, vegetables, meat, poultry, game, butter, eggs, milk, cheese, plants, small animals; port; seaport; ship; solid waste. Part II of the Act concerns: establishment of the Authority, appointment of its members and other procedural matters related to the functions of the Authority, such as meetings and proceedings, disclosure of interest, remuneration, appointment of general manager, port manager and secretary, protection of members. Part III concerns powers and duties of the Authority, including: operating the ports to serve the public interest, regulating and controlling navigation within the ports, maintaining, improving and regulating the use of such ports and the services and facilities therein, exercising the functions relating to shipping, aviation and navigation; supervising the operations of loading, unloading, landing and carrying of all goods to and from all ships and aircraft in a port; compulsory acquisition of land; power to vest land reclamation in the Authority.
Part IV defines financial provisions and the funds of the Authority, their application and the temporary investment of funds. Part V concerns the responsibility of the Authority, the liability in case of loss of goods, and the limitation of liability. Part VI concerns payment of dues, charges and tariffs; detention of ships and goods. Part VII concerns special provisions in relation to ports, including: supply of information, removal of wreck and other obstruction, measures in the event of a fire on board ship; power to issue Regulations concerning: control of persons and vehicles, restriction and control of the depositing of any solid waste, substance or article polluting or likely to cause pollution of the waters of any port, regulation of traffic and navigation of ships and aircraft, protection of ships and aircraft and their cargoes, classification of goods as dangerous goods and restrictions of loading or discharging these goods. Part VIII provides for: penalties, offences and misconduct. Part IX concerns legal provisions. Part X concerns miscellaneous provisions, including: exemption from taxes; power to shoot animals found trespassing on any port.
