Abstract
This Act is enacted to prevent the serious impact of the climate crisis by efficiently capturing and storing carbon dioxide emitted from industrial activities, etc. so as to contribute to the sustainable development of the national economy. The Act consists of 54 Articles divided into 9 Chapters: General provisions; Establishment of basic plan for carbon capture, etc.; Installation of carbon dioxide capture and transportation facilities, etc.; Exploration, selection, closure, etc. of carbon dioxide storage sites; Permission for storage business, etc.; Designation and operation of carbon dioxide capture, storage, and utilization integration complex; Promotion of industries such as carbon dioxide capture; Supplementary rules; Penalties.
The Act lays the legal groundwork for the development and implementation of carbon capture, transportation, storage and utilization policies at national level. The state shall establish carbon dioxide reduction calculation methods and statistical bases necessary for effective management and improvement of carbon dioxide capture, transportation, storage, and utilization. Policies to promote the development of related industries must be established and implemented. The state and local governments shall endeavor to promote education and publicity necessary to raise public awareness of collection, etc. Business operators engaged in collection, etc. must strive for technology development and commercialization, and must actively cooperate with the government's policy on carbon collection, etc. The Act also specifies the approval process for businesses transporting captured carbon dioxide and the support that may be provided by the Minister for the installation and operation of capture facilities. Furthermore, it details the requirements for reporting and inspection related to carbon capture activities, including the submission of annual monitoring reports to the central administrative agency and the Carbon Neutrality Commission. It also outlines the procedures for conducting inspections, including notifying the target of the inspection in advance and providing proper identification. Overall, the Act emphasizes the importance of effective management and regulation of carbon capture activities to ensure safety, efficiency, and compliance with the law. It highlights the role of various stakeholders, including government agencies, businesses, and certification bodies, in achieving the goals of carbon neutrality and sustainable development.
