Abstract
The purpose of this Act is to contribute to developing the agriculture, rural community, and national economy by securing the diversity of the agricultural bio-resources and enhancing the competitiveness of the agricultural bio-industry through comprehensive and systematic preservation and management and sustainable use of the bio-resources.
The Act mandates efforts by state and local governments to acquire agricultural bio-resources, share profits to ensure diversity and sustainable use, and adhere to international norms (Article 3). The Minister of Agriculture, Food and Rural Affairs is responsible for creating a master plan for preservation, management, and use of these resources every five years (Article 5). Immediate measures are required if agricultural bio-resources face depletion or extinction, even without hard scientific evidence (Article 13). Approval from the Minister of Agriculture, Food and Rural Affairs is necessary for individuals intending to obtain preserved agricultural bio-resources from designated agencies (Articles 14, 15 and 16).
The Act further makes provisions, inter alia, for: increasing diversity of agricultural bio-resources and facilitating use thereof, informatization and nurturing of human resources, promoting research and development of agricultural bio-resources and fostering related industries, facilitation of research and exploitation of overseas agricultural bio-resources and international cooperation, offences and penalties.
