Abstract
The purpose of this Act is to prevent any environmental pollution caused by the transboundary movements of wastes and to improve international cooperation by controlling the export, import, and inland transit of wastes for the purpose of enforcing the Basel Convention on the Control of Transboundary Movements of Hazardous Wastes and Their Disposal and bilateral, multilateral or regional agreements based on the same Convention. A person who desires to export or import wastes subject to export or import restrictions shall obtain permission from the Minister of Environment and shall prepare export/import movement documents (arts. 6 to 14). In granting permission on the export or import of wastes, the Minister of Environment may designate any shipment or loading and unloading port or restrict the shipment or loading and unloading zone. Wastes that pose dangers to human health and environment shall be prohibited from being exported or imported. Any wastes shall be prohibited from being exported to any state that lacks proper capacity to dispose of such wastes. The Minister of Environment may have a person to report or may have any related public official enter any office, business place, etc. to inspect the relevant documents, facilities, equipment, etc. The remaining part of the Act makes provisions, inter alia, for: agreements on transit of wastes subject to export or import restrictions, packaging of wastes subject to export or import restrictions, offences and penalties.
