Abstract
This Act aims to improve the quality of people's living and protect maritime assets by preserving and managing the marine ecosystem in a comprehensive and systematic way in order to protect the marine ecosystem from artificial damage, preserve marine biological diversity and promote sustainable use of marine biological resources.
The Act provides for the formulation and for the contents of basic plans on the conservation and management of marine ecosystems. The Minister of Land, Transport and Maritime Affairs may establish the Marine Ecology Research Institute to conduct investigation and observation of changes in marine ecosystems.
The Act provides for the protection of habitats, spawning areas and migratory routes of marine animals. It designates conservation institutions of marine organisms, it takes measures to rescue or treat marine animals in distress or wounded, and it sets out restrictions on the capture or collection of marine organisms under protection. The Act also sets out procedures for the designation and management of protected marine areas, and specifies acts prohibited in these areas. The State shall formulate and implement measures for the conservation of marine biological diversity, and establish and operate the Institute of Marine Biological Resources for the efficient conservation of marine biological resources.
The Act further provides for: establishment and operation of facilities for the conservation and management of marine ecosystems; designation and management of seaside rest areas; conservation of marine landscapes; support for marine ecological tourism; marine ecosystem conservation levies; penalties; etc.
