Abstract
This Act provides for the development of the seed industry and for the protection of breeder's rights, seed production, certification, marketing, etc. concerning new plant varieties. The Act consists of 9 Chapters divided into 176 articles.
Chapter II deals with the following matters: breeder's rights; crops entitled to variety protection and variety protection applications; variety protection fees and variety protection registration; variety protection rights; protection of variety protection right-holders; etc. Variety denomination and variety denomination registration are provided for in Chapter III. Plants to be entered in an official catalogue of varieties shall be rice plants, barley, beans, corn, potatoes, and any other plant prescribed by the Presidential Decree. An application shall be filed to enter in the catalogue of varieties (Chapter IV). Measures for the certification of seeds are provided for in Chapter V. Chapter VI deals with matters related to the distribution, import and export of seeds. The remaining Chapters contain penal and supplementary provisions.
