Abstract
The purpose of this Act is to contribute to the protection of the environment and the enhancement of the quality of life by minimizing the generation of wastes and properly managing the wastes that have been generated. The Act consists of 63 articles divided into 6 Chapters: General provisions (I); Generation and disposal of wastes (II); Controlled waste-disposal certification (II-2); Waste management business, etc. (III); Guidance, supervision etc. for operator of waste disposal business, etc. (IV); Supplementary provisions (V); Penal Provisions (VI). Waste is defined in article 2. Substances that do not apply to this Act are listed in article 3. Local governments shall install and manage waste disposal facilities for wastes to be properly managed and further he shall efficiently carry out waste management services by improving the methods of waste collection, transportation, and disposal. The Mayor/Do governor shall develop a basic plan for the disposal of wastes every 10 years and shall obtain approval from the Minister of Environment which in turn shall draw up a comprehensive national plan for controlling wastes based on the basic plan and the outcome of the statistical survey of wastes. Chapter II contains provisions on household and industrial waste disposal. Any person who intends to run a business of collecting, transporting or disposing of the wastes shall submit plans for waste management business to the Minister of Environment (art. 26). Waste disposal facilities shall be installed in compliance with the standards as prescribed by the Ordinance of the Ministry of Environment and shall be inspected by an inspection agency (art. 30). Any person installing and managing waste disposal facilities shall employ a technical manager who will take charge of technical affairs in the maintenance and management of such facilities. Any person who is engaged in the recycling of industrial wastes generated by others and who falls under any of the subparagraphs listed in article 44-2 shall provide himself with the facilities for the storage and recycling of wastes.
