Abstract
This Law consisting of 3 articles modifies Article 31 of Law No. 49 of 2016 in two key ways (1) eliminating the requirement for Kuwaiti bidders, where the original text required that the tender submission be made by a Kuwaiti individual or company. The amended text removes this requirement, allowing both Kuwaiti and foreign entities to submit bids; (2) removing the discretionary authority previously granted to the contracting authority, which allowed them to choose between national or foreign companies for contracts, has been eliminated. Now, the process is open to all, promoting competition.

This Law enters into force on the date of its publication in the Official Gazette.
Notes
This Law also amends Article (24) of the Decree-Law No. 68 of 1980 issuing the Commercial Law, removing the requirement for a local agent, allowing foreign companies to establish branches and operate directly in Kuwait without the need for a local partner.
