Abstract
These Regulations, consisting of 9 articles, refer to Article 144 of the Environment Law of Kuwait, which establishes that, subject to the given articles, the Competent Minister can, upon request, accept settlements for unintentionally caused pollution by requiring a minimum payment and/or covering pollution combating costs. Crucially, accepting this settlement leads to the termination of criminal proceedings against the accused. Under Article 4, the Director of the Environment Public Authority has the discretion to accept, reject, or refer a settlement request to the competent technical committee. According to Article 5, a reconciliation request will not be considered unless the violator has removed the environmental impact and its causes, and has committed to restoring the affected area to its original condition. Article 6 further stipulates that the competent technical departments must verify that the remedial actions have been completed before reconciliation can proceed. The Regulations also include detailed tables outlining the compensation amounts and environmental fines applicable in cases where reconciliation is accepted for violations committed by individuals or establishments.
