Abstract
This Regulation consisting of 42 articles provides in article 2 for the responsibilities of the competent Authority that in Kuwait is represented by the Public Authority for Agriculture Affairs and Fish Resources, and they are as follows (i) development of plans and programs for the production of seeds, potato seeds, and seedlings; (ii) control of seed and seed preparations, including classification, sterilization, packaging, and marketing, and determining the controls and conditions for control and inspection; (iii) scientific requirements for seed and seedlings' production; (iv) determination of types and varieties of seeds allowed and specifications of the propagation categories; (v) rules for registration and licensing of crops and varieties, including necessary procedures, and data, and keeping records for this; (vi) determination of the types of pests, the ways to combat them, and clarifying the controls and responsible authorities in respect of them; (vii) establishment of controls and systems for handling seeds and seedlings; (viii) determination of controls related to the provisions of the law and related regulations; (ix) determination of conditions and specifications of the plants for trading; (x) marking specifications; (xi) rules for registration; (xii) temporary or permanent prohibition of cultivation or export of any seed or variety of seeds and seedlings; (xiv) monitoring and inspection of plant tissue culture laboratories, nurseries, and flower shops. For the registration of any type of crop, the application must be submitted in accordance with the terms, conditions and controls set by the competent Authority (art.3).
Article 4 provides for the formation, by a decision of the competent authority, of a Committee for Registration of Seeds, Potato Seeds, Seedlings, and the Agricultural Cooperation, with the following tasks (i) suggesting regulations, establishing and approving the general policy related to the regulation of seed and seed production and seedlings; (ii) issuing permission for production and trade; (iii) formation of specialized technical work teams, on a permanent or temporary basis; (iv) issuing specifications for the sale; (v) improving the efficiency of workers in this field; (vi) inventory of the agricultural sector’s latest developments in the field of seed and the development of plans and programs; (vii) establishing the conditions for registration; (viii) determining costs for laboratory analysis; (ix) forming sub-committees to inspect exhibitions, shops, stores, nurseries, flower shops, and cultivation laboratories. A sub-committee is formed to organize the registration procedures (art.6), while article 7 establishes a team for examinations and inspections. The requirements for the farms of production and propagation are provided in article 8. The conditions relating to production to be met after obtaining consent from the competent authority are described in Article 11.
The Regulation includes the requirements necessary for the following (i) seeds and seedlings offered for sale; (ii) sell flowers; (iii) production of citrus, some kinds of fruit, some kind of vegetables, and ornamental plants. The commitments of the producer are provided in article 14, while Control and Inspection Procedures are in article 15. It is not permissible the trade or the advertisement, except after they have been examined and tested by a competent body specified by the competent authority (art.23). Other provisions regard (i) examination procedures (art.25); (ii) trading regulation (art.26); (iii) storage (art.33); (iv) export and import (art.35); (v) duties of the importer (art.36).
