Agreement on the distribution and use of the water of Khorgos river.

The border representatives of the Republic of Kazakhstan and of the People’s Republic of China, on basis of the spirit of friendship to strengthening good neighborly relations between Kazakhstan and Chinese residents living in the border zone on both banks of the river Khorgos and principle of equity, as a result of consultations on distribution and use of the waters of the river Khorgos and the principle of equity, as a result of consultations on distribution and use of the waters of the river Khorgos, have decided to make some changes and additions to the previously signed: “Agreement on the distribution and use of the waters of the Khorgos river dated April 30, 1965 year" and "Protocol on the procedure for the work of the joint Soviet-Chinese control commission for distribution of the waters of the Khorgos River dated November 25, 1975”. The amount of water taken by any party from the upper reaches of the Khorgos river should not exceed 1/2 of the total, at that time, the flow of its upper reaches. The amount of water taken from the lower reaches of the river should also not exceed 1/2 of the total flow of its lower reaches. The construction of new water intake structures, the expansion and reconstruction of old ones, the implementation of hydraulic engineering, bank protection or any other measures to take water from the Khorgos river must be agreed in advance with the other party. It is possible to carry out the above works only after reaching a bilateral agreement. If, for a natural reason, changes occur in the river bed and one of the parties has difficulties in taking water, then it can declare this to the other side and, after a bilateral agreement is reached through consultation, resolve this issue.
