Governmental Decree No. 135 validating the Regulation for import into the territory of the Republic of Kazakhstan, export from the territory of the Republic of Kazakhstan and transit of hazardous and other wastes through the territory of the Republic of Kazakhstan.

This Governmental Decree establishes import into the territory of the Republic of Kazakhstan, export from the territory of the Republic of Kazakhstan and transit of hazardous and other wastes through the territory of the Republic of Kazakhstan. Transboundary transportation of hazardous waste across the territory of the Republic of Kazakhstan is carried out on the basis of the conclusion of the authorized body in the field of environmental protection. Import into the territory of the Republic of Kazakhstan from countries that are not members of the Eurasian Economic Union, and export from the territory of the Republic of Kazakhstan to these countries of hazardous waste for the purpose of their further recovery are carried out on the basis of a license issued by a state body determined by the Government of the Republic of Kazakhstan. Hazardous waste cannot be exported to States Parties to the Basel Convention and developing countries that have prohibited the import of hazardous waste under their legislation, or where there is reason to believe that the use of these wastes will not be carried out in an environmentally sound manner, as well as to areas south of 60 degrees southern latitude.
