Order No. 138 of the Minister of Ecology, Geology and Natural Resources of the Republic of Kazakhstan validating the Regulation on issuance by the administrative body of permits for import into the territory of the Republic of Kazakhstan, export and (or) re-export from the territory of the Republic of Kazakhstan of wild flora species, their parts and derivatives falling under the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES).

This Order establishes the procedure for on issuance by the administrative body of permits for import into the territory of the Republic of Kazakhstan, export and (or) re-export from the territory of the Republic of Kazakhstan of wild flora species, their parts and derivatives falling under the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES). Administrative body shall be intended national administrative body, appointed in accordance with Article IX of the Law of the Republic of Kazakhstan of 6 April 1999 On accession of the Republic of Kazakhstan to the Convention on International Trade in Endangered Species of Wild Fauna and Flora . Applicant shall be intended a natural or legal person, branch or representative office of a legal entity, a licensee, a holder of a permit of the second category, who have applied to the relevant licensing authority to undergo the licensing or permitting procedure or who have sent a notice. One of the grounds for obtaining a permit to import into the territory of the Republic of Kazakhstan of wild flora species, their parts and derivatives falling under the Convention on International Trade in Endangered Species of Wild Fauna and Flora shall be conclusion of a scientific body. To obtain a certificate for import into the territory of the Republic of Kazakhstan and export from the territory of the Republic of Kazakhstan of wild flora species, their parts and derivatives falling under the Convention on International Trade in Endangered Species of Wild Fauna and Flora, the applicant must submit in paper form to the scientific authority the following documentation: (a) an application for conclusion to import into the territory of the Republic of Kazakhstan and export from the territory of the Republic of Kazakhstan of wild flora species, their parts and derivatives falling under the Convention on International Trade in Endangered Species of Wild Fauna and Flora in accordance with Annex 1; (b) when importing specimen into the territory of the Republic of Kazakhstan, a copy of a permit export permit or re-export certificate, if the specimen is included in annexes I, II, III of the Convention; (c) a copy of a forest ticket, in case of withdrawal of wild flora species, their parts and derivatives, from the natural environment growing on the territory of the state forest fund of the Republic of Kazakhstan; (d) in case of import to and export from the territory of the Republic of Kazakhstan, a copy of the contract or agreement between the exporter and the importer confirming the intention to carry out this action, as well as a document containing information on the quantity and volume of exported and (or) re-exported products, the type of product and its description (live, ikebana).
