Abstract
This Decree, divided into 9 chapters and consisting of 32 articles, provides for implementation of development projects with the aims to ensure compensation, resettlement and assistance to affected people and improve their living conditions and socio-economic development of the nations. The Decree applies to development projects of the state and private sectors including foreign and domestic projects, affected people and all relevant stakeholders who are subject to compensation and resettlement.
The Decree explains relevant terms and defines that compensation shall be in form of land, material or money for the land, agricultural products, livestock and incomes. The activity of compensation and resettlement complies with the following principles: protection of the rights and benefits of affected persons; ensuring equality, correctness, transparency and coordination between project owner, affected people, state agencies and stakeholder. Chapter 2 concerns preparation, implementation and evaluation of compensation plans. Chapter 3 concerns preparation, implementation of resettlement plans and resettlement site development. Chapter 4 concerns livelihood rehabilitation. Chapter 5 concerns rights and obligations of the project owner and of the affected people. Chapter 6 provides for the creation of the committee for compensation and people resettlement. Chapter 7 concerns settlement of requests on compensation and resettlement. Chapter 8 concerns monitoring and examination. Chapter 9 concerns final provisions.
