Ministerial Decree no. 0438 of 2023 on new plant varieties.

This Decree, consisting of 36 articles, determines principles and regulations regarding the registration of plant varieties, the implementation of new plant breeding work, the related activities, the conditions for granting the right to protect groups of plant, on the basis of their genetic and botanic characteristics. Matters covered by this Decree include: conditions for plant registration; application for registration; characteristic of a new variety; description of plant species; intellectual property rights of plant breeders; inspection to protect breeders against illegal behaviour; maintenance of protection period and related fees; cancellation of registration in case of false or misleading information; transfer of rights; permission to use the new registered variety for research purposes; transport documents; powers of National Plant Breeding Organisation.
