Abstract
This Act sets forth provisions in Part I on the form of contract of tenancy, obligations of landlords and tenants, contract farming, registration of contract of tenancy or memorandum, effect of unregistered contract, determination and termination of the contract, notification procedures for termination of the contract, duration of the right of tenant after notification, assignment of contract with the consent of landlord, prohibition of sublet, liability of incoming owners in case of alienation or devolution of ownership of a small holding, liability of the owner of hypothecated land. Furthermore, Part II underlines fair benefit-sharing between landlord and tenant by setting forth provisions on compensation for improvements made by tenants upon the termination of his or her tenancy, as well as provisions on (i) consent of landlord to improvements, (ii) agreement between landlord and tenant upon compensation, (iii) service of notice of arbitration, (iv) procedures of compensation, and (v) assessment of improvements. This Act shall apply to any contract of tenancy. This Act states that the boundaries of the smallholding shall be properly marked by the landlord before the commencement of the terms of any contract of tenancy. Every landlord may reserve to himself or herself the exclusive right regarding specified trees. The Minister may make regulations for carrying the provisions of this Act into effect and without prejudice to the generality of this section. Finally, this Act sets forth provisions on dispute settlement.
