Abstract
This Act, divided into eight parts and consisting of 53 articles, provides a legal framework for implementing the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES) and for related matters, and therefore applies to all specimen of animal and plant species specified in Appendices I, II or III of CITES. The Act defines the following terms and definitions: captivity bred; certificate of artificial propagation; certificate of captive breeding; certificate of introduction from the sea; marks and other means of identification; non-commercial purpose; controlled environment, in relation to plants and animals; country of origin; primarily commercial purpose; transhipment. The Act concerns the following matters: special conditions relating to species born or bred in captivity or artificially propagated; designation and powers of management authority and scientific authority, including: coordination of the implementation of CITES and co-operate with relevant national authorities, granting permits, certificates and permissions in accordance with the provisions of CITES, monitoring trade in specimens as required by CITES, definition of specific prerequisites for registration of any person or business involved in the captive breeding, international trade, or artificial propagation of species, taking all the necessary steps for the protection, conservation and management of wild fauna and flora against over-exploitation through international trade, promoting public awareness of species of wild flora and fauna which are considered vulnerable, threatened, at risk, endangered, enhancing the implementation of a recovery and management plan in Saint Lucia for wild fauna and flora.
Further matters covered by this Act include: application of precautionary principle to conserve natural resources or their environment; prohibitions and restriction on international trade for specimen listed in Appendix I, II and III of CITES; restriction on production of captive bred animals or artificially propagated plants; restriction on possession and sale for the purposes or as a result of international trade; application for registration and permits; import and export of specimens; minimising the risk of injury, damage to health, or cruel treatment for specimens; exemption in relation to transit and transhipment; exemption in relation to zoos and circuses; enforcement measures; offences and penalties.
