Abstract
The purpose of the Labour Act is to provide a comprehensive framework for regulating the employment relations, promoting fair labour practices and ensuring the welfare and rights of both employers and workers. The Act addresses issues such as working conditions, wages and dispute resolution mechanisms within the labour market. The Act further aligns national laws with international standards. The Act identifies fundamental principles, such as prohibition of child labour and freedom of association and the effective recognition of the right to collective bargaining. Part IV regulates the functions and establishes a serie of labour institutions: National Advisory Committee on Labour, Wages and Conditions of Employment Advisory Board; Industrial Relations Council; Directorate of Dispute Prevention and Resolution; The Labour Court; The Labour Appeal Court. Part V concerns collective bargaining; Part VI employment relationship, liability and termination; Part VII regulates recruitment and local and foreign contracts. The Act extends maternity leave to a worker who has a stillborn. It also introduces the following leaves, paternity leave, family responsibility leave, bonding leave where a worker has adopted a child and compassionate leave where a worker has lost an immediate family member.
