Abstract
This Protocol add to and amends the Treaty on the Lesotho Highlands Water Project between the Government of the Kingdom of Lesotho and the Government of the Republic of South Africa mainly to redefine the functions and responsibilities of the Board of Directors of the Lesotho Highlands Development Authority, the Board of Directors of the Trans-Caledon Tunnel Authority and hierarchical relationship between these three bodies. There shall be an Implementing Authority, who shall have the responsibility for the implementation of any part of the Project in the Republic of South Africa implemented in addition to Phase 1, in accordance with the provisions of this Treaty, and shall be vested with all powers necessary for the discharge of such responsibilities. During the implementation of such part the Implementing Authority shall also have the responsibility for the operation and maintenance of the existing part of the Project in the Republic of South Africa. Any dispute concerning the interpretation or application of this Protocol shall be resolved in accordance with the provisions of Article 16 of the Treaty.
