Abstract
These Regulations, comprising 174 sections, establish detailed rules and procedures governing public procurement and the disposal of public assets in Lesotho and apply to all procuring entities subject to the Act. They regulate the institutional framework for procurement, including the functions of the Public Procurement Authority, Central Tender Board, procuring entities, procurement committees and evaluation committees, and provide for procurement planning, reporting, auditing, monitoring, record keeping and information disclosure. The Regulations establish procurement methods and procedures, including national and international competitive tendering, limited competitive tendering, single-source contracting and framework agreements, and set requirements for bidding documents, prequalification, submission and opening of bids, bid securities, evaluation, contract award and contract management. They also regulate the procurement of consultancy services and prescribe different methods for the selection and evaluation of consultants. Particular provisions address environmental and social considerations in public procurement, including restrictions on the procurement of goods harmful to human health, the environment, domestic animals, wildlife and flora, environmental impact assessment of works at the planning stage, and consideration of repair and reuse of goods before replacement. The Regulations further provide for preference schemes, debarment of suppliers, contractors and consultants, force account and community participation, as well as procedures for the valuation and disposal of public assets through public bidding, auction, direct negotiation, destruction, conversion, trade-in, transfer or donation. They also establish procedures for review of procurement decisions by the Procurement Tribunal and appeals to the courts. Annexures contain prescribed procurement and disposal forms, a sample price-adjustment formula, procedures and standards for works, and declarations and codes of ethical conduct.
