Abstract
The Criminal Code of the Republic of Lithuania regulates criminal liability by defining crimes and criminal misdemeanours, establishing the conditions of criminal responsibility, and providing for penalties applicable within the national jurisdiction. The Code is structured into a General Part, which sets out the general principles of criminal law, and a Special Part, which establishes liability for specific categories of offences, including offences against the person, property, public safety, economic activity, public administration, justice and other protected interests.
With respect to environmental offences, Chapter XXXVIII (“Crimes and Criminal Misdemeanours against the Environment and Human Health”) establishes criminal liability for violations of environmental protection requirements and the unlawful use of natural resources. The Code provides for liability for breaches of legal rules governing environmental protection and the use or supervision of structures involving hazardous substances, potentially dangerous installations, or dangerous activities, where such conduct creates a risk to human life or health or results in major damage to environmental elements, including air, land, soil, water, fauna, flora, and other organic or inorganic substances.
The Code further establishes liability for specific offences affecting environmental components. It provides for criminal liability for the unlawful manufacture, import, export, use or placing on the market of ozone‑depleting substances or their mixtures, for the illegal transboundary movement of waste, and for the unlawful management or disposal of waste into the environment. It also establishes liability for the pollution of marine waters from ships in breach of applicable international requirements.
In addition, the Code provides for criminal liability for acts affecting protected environmental areas and natural heritage objects, including their destruction or damage. It regulates offences relating to wildlife and natural resources, including illegal hunting, fishing or other unlawful use of wild fauna, as well as offences involving protected animal species. It also establishes liability for illegal logging, destruction or damage of forests, and the unlawful collection, destruction, or trade in protected species of wild plants, fungi, or their parts.
The provisions of this Chapter apply to both intentional and negligent conduct and establish that criminal liability extends to legal persons. The Code provides that such offences are punishable within the general system of criminal penalties and may entail additional measures, including confiscation of property and obligations to compensate for damage.
