Abstract
This Act establishes the requirements for the fertilizers traded and supplied to the internal market of the Republic of Lithuania, the obligations of economic operators, users of fertilizing products, the requirements for the placing on the market and supply of fertilizing products, the inclusion of the traded and supplied fertilizers in the Identification List of Fertilizers and the requirements for cancellation of fertilizers from the Identification List of Fertilizers, the market surveillance procedure and the liability for violations of this Law. This Law applies to fertilizers traded and supplied to the market insofar as these products are not regulated by European Union legislation. Identification List of Fertilizers, the description of the inclusion of fertilizers therein and the procedure for its cancellation of fertilizers therefrom shall be approved by the Minister of Agriculture of the Republic of Lithuania. When the fertilizer is not included in the Identification List, the economic operator shall submit a request to the competent Authority to include the fertilizer in the Identification List and the documentation supporting the compliance of this fertilizer with the requirements set out in this paragraph, proving that: (a) the fertilizer complies with the general safety and quality requirements of the functional fertilizer products category assigned and approved by the Minister of Agriculture; (b) a positive effect of the fertilizer on plant nutrition, physical, chemical, biological and biological properties of the fertilizer has been demonstrated for at least three consecutive years without endangering human and animal life, public health or the environment under its intended use; and (c) fertilizer shall be cancelled from the Identification List if it is established that the fertilizer does not meet at least one of the requirements referred to in the aforesaid paragraph 2. Manufacturers must: (a) ensure that fertilizers in the Identification List meet the criteria set out in the Identification List; (b) perform assessment of the conformity of fertilizer products with the established requirements and prepare the technical documentation; in cases where there is no standard for an approved test method, the conformity of the fertilizer product may be based on the non-accredited laboratory test protocol; (c) keep the fertilizer technical documentation for five years after the product has been placed on the market for inspection by the approved body; (d) ensure that fertilizers are labeled in accordance with the packaging and labeling requirements laid down by the Minister for the Economy and Innovation or, where the fertilizer is delivered without packaging, in a national language in a document accompanying the fertilizer; (e) when placing on the market or transiting through the territory of the Republic of Lithuania ammonium nitrate fertilizers with high nitrogen content (N (nitrogen)> 28 per cent), perform the tests specified in Paragraph 2 of Article 4 of this Law and follow the procedure and deadlines specified therein; and (f) upon request from the Authority, to provide the Authority with all the information and technical documentation necessary to assess the conformity of the fertilizer product with the requirements of Article 4 of this Law in the official language and to cooperate with the authorized body on any action taken by persons exposed to fertilizers, with a view of protecting human life and health, animal and plant life, and the environment. This Act consists of VIII Chapters divided into 20 Articles, Chapter I lays down general provisions. Chapter II establishes the procedure for inclusion in and cancellation from the Identification List of Fertilizers. Chapter III establishes requirements for third products. Chapter IV establishes obligations of economic operators. Chapter V regards use of different products. Chapter VI regards maintenance of distribution markets. Chapter VII establishes liability. Chapter VIII lays down final provisions.

Entry into force notes
