Abstract
The Rules on Anti-Corruption Assessment of Draft Legislation establish the state or municipal institutions that are drafters of legal acts, civil servants and employees working under employment contracts in the cases specified in Paragraph 1 of Article 8 of the Law on Prevention of Corruption the procedure for anti-corruption assessment of draft regulatory enactments. Anti-corruption assessment of draft legal acts shall be intended assessment of draft legal acts in order to identify the shortcomings of the legal regulation envisaged in them, which may create conditions for corruption. In a state or municipal institution, the anti-corruption assessment of draft legal acts is performed by the assessor of the draft legal act. The evaluator of a draft legal act may not be instructed to perform an anti-corruption assessment of a draft legal act prepared by him. When performing an anti-corruption assessment of a draft legal act, the evaluator of the draft legal act shall analyze its content, assess it in accordance with the anti -corruption assessment criteria specified in the annex to the draft anti-corruption assessment certificate related to the conditions for the emergence or spread of corruption. The Special Investigation Service of the Republic of Lithuania, when performing anti-corruption assessment of legal acts or their drafts, may examine the anti-corruption assessment of draft legal acts performed by state or municipal institutions, as well as provide these institutions with comments and proposals on draft legal acts. anti-corruption assessment.
