Abstract
This Law establishes the legal framework for ensuring nuclear security, the duties of persons engaged in nuclear energy sector and nuclear and/or nuclear fuel cycle materials, duties and responsibilities in nuclear security as well as the functions of state institutions in the field of nuclear security related to state regulation. This Law establishes the basic principles of nuclear security aimed at ensuring the highest possible level of nuclear security and minimizing the risks to human beings, their property and the environment from the functioning of nuclear facilities and any other activities related to nuclear energy and/or nuclear fuel cycle materials management. Basic principles for ensuring nuclear security shall be as follows: (a) the principle of responsibility for ensuring nuclear security - full responsibility for protecting nuclear security rests with those responsible for the nuclear facility or activity that poses the risk of ionizing radiation; (b) the principle of state regulation of nuclear security - in order to ensure security, an effective regulatory and governance structure must be created and maintained, including an independent state regulatory and supervisory authority in the field of nuclear energy and other activities in the field of nuclear energy and nuclear fuel cycle materials; (c) the principle of nuclear security priority for organizations engaged in nuclear activities and other activities in the field of nuclear energy and nuclear fuel cycle management; (c) the principle of reasonableness and expediency of activities - the economic, social or other benefits of a nuclear facility or other activity related to the acquisition, possession, use or transport of nuclear and/or nuclear fuel cycle materials must be objectively greater than the risk of possible operational activities; (d) the principle of nuclear safety optimization - nuclear safety assurances are used to achieve the highest possible rational level of nuclear security, but there must be no requirements that would unreasonably prevent the commissioning of a nuclear facility or other acquisition, possession, use of nuclear energy and/or nuclear fuel cycle materials or transportation thereof; (e) the principle of reducing the risk to the population - nuclear security measures must ensure the lowest possible risk that any person will be exposed to ionizing radiation and will therefore suffer damage, the effect of ionizing radiation shall be as small as possible and not exceed the limit values prescribed by laws and other legal acts of the Republic of Lithuania; (f) the principle of protection of the present and future generations - the present and future generations and the environment must be protected from the harmful effects of ionizing radiation; (g) accident prevention principle - all reasonable measures must be taken to prevent nuclear or radiological accidents and, if they do occur, to mitigate their effects; (h) emergency preparedness and response principle - emergency preparedness and response measures must be applied in the event of nuclear and radiological emergencies, other radiological hazards; and (i) the principle of protection against natural or man-caused ionizing radiation due to unregulated human activities - appropriate and optimized measures should be taken to protect against the effects of natural or man-caused exposure to ionizing radiation. This Law consists of X Chapters divided into 51 Articles. Chapter I lays down general provisions. Chapter II regards nuclear security, documentary system, administrative decisions and nuclear impact prevention measures. Chapter III regards state nuclear security regulatory system. Chapter IV regards nuclear energy project manufacturer (contractor), nuclear energy subsidiary organizations or other activities related to nuclear energy and/or nuclear fuel cycle materials. Chapter V regards issuance of licenses, authorization and certification for nuclear security. Chapter VI regards nuclear security assessment. Chapter VII regards prevention and management of nuclear and radiological emergencies and accidents. Chapter VIII regards access to information. Chapter IX establishes scientific and technical substantiation of nuclear security. Chapter X lays down final provisions.
