Abstract
Article 32 shall be amended to add the following wording: “Environmental damage is recognized if there is a direct or indirect adverse effect to: (a) maintaining the favorable conservation status of species or habitats, as well as the state of biodiversity, forests, landscapes, protected areas; (b) ecological, chemical, microbiological and/or quantitative status and/or ecological capacity (potential) of surface and groundwater, as defined in Water Law, as well as the state of the marine environment as described in the Law on the Protection of the Marine Environment; (c) soil, intended by soil pollution, when the pollutants spread on the surface, penetrate subsoil; and (d) other environmental elements or other functions.” Article 33 shall be amended to add the following wording: “The Ministry of the Environment, its subordinate or other state or municipal authorities, in accordance with its competence, may bring actions for damages to the environment and other damages to the economic operator or another person who has caused the environment damage or caused an imminent (actual) threat to the environment within five years from the date on which the responsible economic operator or other person has been identified or measures to prevent environmental damage have been completed.”
