Order No. D1-310 approving the Description of the Procedure for the Use of Wild Plants and Mushrooms.

The Regulation establishes the procedure for the use of wild plants and fungi resources, including the collection of wild plants, their parts, seeds, spores, flowers, fruits (berries, nuts) and roots, mushroom collection, sap tapping, bark removal, grazing and mowing in forest land, and other activities related to the taking of wild plants and fungi from the natural environment. It also regulates the use of wild plants and fungi for education, science and other purposes and for the formation of botanical and mycological collections. The Regulation does not apply in cases specified therein, including where the use of wild plants and fungi is regulated by other legal acts.
The Regulation provides that mushrooms may be collected provided that forest litter is not disturbed. It sets conditions for the collection of seeds, spores, berries and plant parts, including requirements not to uproot, damage or destroy plants and to leave part of the plant population uncollected. It establishes rules for collecting leaves, buds, bark and other plant materials, and for taking moss and lichens in specified locations. It also regulates sap tapping, including requirements on tree diameter, drilling height and depth, and sealing of holes. Provisions on grazing and mowing in forest land are included. The Regulation sets restrictions for certain species listed in an annex and provides for consent requirements in cases established by law. It repeals several previous ministerial acts.
