Decree of the Cabinet of Ministers No.516 validating the procedure for applying the criteria for the termination of the application of waste status of ash obtained from wood combustion plants.

This Regulation determines the procedure for applying the criteria for terminating the application of waste status of ash obtained from wood burning facilities. Collected ash shall be intended ash collected from the wood burning equipment of the ash producer and which has not been checked for compliance with the criteria mentioned in Annex 1 of this Regulation for the termination of the application of waste status. Ash obtained from wood burning equipment shall be considered as secondary raw materials in the sense of this Regulations, if: (a) after the end of the application of the waste status, the ash is planned to be sold on the market for further use in the construction of roads or soil embankments (as sound-absorbing elements) or in the production of cement, concrete, potash and caustic potash; and (b) ash meets all the criteria mentioned in Annex 1 of these regulations for the termination of waste status. The processor ensures that: (a) for each batch of obtained ash, a declaration on compliance of the ash with the criteria for the termination of the application of the waste status (Annex 2) has been filled out and attached; (b) the accounting of collected ash and obtained ash is carried out in accordance with the regulatory enactments on environmental protection official statistics and polluting activity report forms; and (c) each lot of the obtained ash is identifiable during transportation, providing the State Environmental Service with the opportunity to receive the original declaration of conformity from the processor upon request.
