Abstract
Article 3 shall be amended to add the following wording: Operations with sources of ionizing radiation are permitted if the following basic principles are observed: (a) responsibility for safety - primary responsibility for safety is assumed by the natural or legal person who is responsible for activities with sources of ionizing radiation; (b) state responsibility - the state creates and maintains an effective legal system in the field of radiation safety and nuclear safety; (c) safety management - relevant institutions and organizations that perform or monitor activities with sources of ionizing radiation that create a radiation risk; (d) substantiation of operations with sources of ionizing radiation - the achieved positive result exceeds the negative effects or damages caused by activities with sources of ionizing radiation; (e) optimization of protection against ionizing radiation - protection against ionizing radiation is optimal, if available the highest level of safety that can reasonably be achieved during all operations with sources of ionizing radiation is ensured; (f) limitation of human safety risks - radiation risk control measures ensure that a person is not exposed to such a risk of possible harm that does not comply with the regulatory enactments on protection against ionizing radiation; (g) protection of current and future generations - people and the environment are protected from radiation risks both now and in the future; (h) accident prevention - all necessary measures are taken to prevent a nuclear accident or a radiation accident and mitigate its consequences; (i) preparedness for accidents and actions in the event of an accident - measures are provided to ensure preparedness for nuclear accidents or for radiation emergencies and their response; and (j) protective measures to reduce radiation risks - protective measures are justified and optimized so that would reduce existing or unregulated radiation risks.
