Abstract
This Resolution consisting of 18 articles aims to establish the Lybian Ports and Maritime Transport Authority responsible for implementing the general policy in the field of ports and maritime transport, developing the necessary plans and programs for this purpose, and supervising their implementation. In particular, it shall (i) implement the provisions of the Libyan Maritime Law and related legislation on ports and maritime transport, and propose necessary amendments to serve the Authority's area of work; (ii) study, design, implement, develop, and maintain commercial seaports, and participate in the study, design, and implementation of oil and industrial ports; (iii) define maritime professions in the ports within the Authority's activities and take necessary measures regarding the issuance of seafarers' passports by the relevant authorities; (iv) issue licenses for maritime professions for port workers; (v) issue licenses for national ships and marine units, as well as certificates of seaworthiness; (vi) grant work permits to foreign marine units to operate in ports and territorial waters and implement monitoring procedures; (vii) issue competency certificates for maritime officers and engineers; (viii) manage ports in accordance with national legislation; (ix) collect fees and revenues for ports; (x) represent Lybia in the International Maritime Organization and other relevant regional and international organizations; (xi) study international treaties and agreements related to ports and maritime transport; (xii) investigate maritime accidents and prepare technical reports related to them; (xiii) work to protect the marine environment and prevent its pollution by implementing national and international legislation; (xiv) propose the determination of fees for services provided to others; (xv) train and qualify national personnel in the field of maritime transport and ports, and develop necessary programs for this purpose. The work of the Authority shall not prejudice the competencies assigned to the General Authority for Marine Wealth. The Authority is managed by a management Committee mainly tasked with developing and implementing executive programs to achieve its objectives, sourcing necessary needs, preparing organizational structures and technical regulations, drafting the estimated budget, approving and managing the documentary cycle, reviewing and proposing contracts, and suggesting training plans to enhance employee efficiency.
The two Annexes include (1) the list of the Ports affiliated with the Ports and Maritime Transport Authority; (2) the list of the wharves and platforms subject to the supervision of the Ports and Maritime Transport Authority.
