Abstract
This Law, comprising 36 articles, establishes the Agricultural Inspection Agency in each municipality under the General People’s Committee for Agricultural Reclamation and Land Reconstruction. The agency is responsible for monitoring the activities of agricultural companies, establishments, and projects, as well as all entities within the agricultural reclamation and land reconstruction sector. It aims to detect deficiencies and their causes, and to report these findings to the People’s Committee for Agricultural Reclamation and Land Reconstruction in the municipality. More in detail, the main tasks of inspectors are (i) inspect agricultural and arable land to ensure compliance with the Agricultural Land Protection Law and take immediate action against violations; (ii) prevent unauthorized construction on agricultural lands, requiring licenses from the People’s Committee for Agricultural Reclamation and Land Reconstruction; (iii) verify the validity of water well drilling licenses for ongoing operations; (iv) prevent damage to agricultural machinery and equipment due to intentionality or negligence; (v) protect public forests from encroachment, such as grazing, fires, or logging, ensuring usage complies with legal conditions; (vi) prevent the cutting, uprooting, and improper use or waste disposal in public forests and contribute to forest protection efforts; (vii) protect crops, agricultural products, and animal production stations from fires, natural disasters, pests, and other forms of damage; (viii) prevent unauthorized collection or use of forest products like charcoal and firewood, adhering to the Pastures and Forests Protection Law; (ix) protect wild game from extinction and enforce hunting laws and regulations; (x) prevent harm to livestock; (xi) inspect plants and animals entering the country for diseases and pests in coordination with agricultural quarantine authorities; (xii) enforce all agricultural laws, particularly those overseen by the People’s Committees for Agricultural Reclamation and Land Reconstruction, related to agriculture, livestock, and water; (xiii) ensure compliance with agricultural guidance decisions; (xiv) address crimes violating the Economic Crimes Law in the agricultural sector.
Chapter Two addresses the formation, organization, and duties of the Agricultural Inspection Agency. Chapter Three focuses on the appointment, promotions, bonuses, and leave policies for agricultural inspection officers. Chapter Four covers disciplinary actions related to the officers' duties. Chapter Six outlines the reasons that may lead to the termination of service.
