Abstract
This Law consisting of 32 articles divided in 3 Chapters aims at establishing the National Anti-Corruption Commission (NACC) with the following main competences (i) prepare proposals regarding the amendment of anti-corruption legislation; (ii) review and evaluate the anti-corruption reports issued by local, regional, and international organizations, examine the status of the Libyan government therein, and propose the appropriate procedures in their regard; (iii) receive, examine, and keep financial disclosures, and request any data or clarification related thereto; (iv) contribute to adding names to the receivership lists; (v) coordinate with the Central Bank of Libya and the relevant entities to reclaim the funds resulting from corruption inside and outside the country; (vi) represent Libya before international and regional anti-corruption organizations and conferences; (vii) investigate and detect crimes of corruption, in particular crimes concerning money laundering, crimes against public funds and public trust, economic crimes, crimes of misuse of position or occupation, mediation, and favoritism, illicit gains, and any other activities set forth by the United Nations Convention against Corruption.
The NACC chairman may order a freeze on any funds suspected of being acquired through a crime of corruption (art.4). Article 7 states that the NACC has a Council composed of a chairman, managing the NACC’s affairs and handling the administrative and technical oversight of its work and employees, and five full-time members. The main tasks of the Council are (i) draft the general policy of the NACC; (ii) submit proposals related to anti-corruption legislation; (iii) work to activate the UNCAC and international, regional, and bilateral anti-corruption agreements; (iv) ratify periodic anti-corruption reports; (v) monitor Libya’s fulfilment of its international commitments. The NACC chairman and Council members shall have the capacity of judicial officers regarding the implementation of the provisions of the present Law (art.18). The NACC shall take the necessary measures to protect witnesses, experts, and informants against any attack they may be exposed to due to their testimony, expert opinion, or reporting (art.22).
