Abstract
These Regulations, consisting of 24 articles, establish that pesticides can be imported, manufactured, or sold only if registered within Libya. Importation of registered pesticides is permissible solely through authorized authorities and requires the administration’s approval, with import applications submitted on the approved form. When requesting the registration of any agricultural pesticide, the following must be taken into account: samples of pesticides to be registered must be provided along with all technical information and data required for study, such as active ingredients, chemical composition specifications, toxicity, methods of use, pests and diseases the pesticide resists, and the waiting period before crop collection. Additionally, the analysis methods for conducting conformity examinations and analyzing the residual effects of the pesticide on plants, soil, and water must be included. A certificate from the competent authority in the country of origin is also required, proving that the pesticide is authorized for use and circulation in that country with the same specifications and purposes.
Article 9 lists the circumstances under which pesticide registration may be canceled and its circulation prohibited. Under Article 11, a Specialized Committee is formed, responsible for regulating and registering pesticides after they are presented by the administration. This committee also has the authority to cancel the registration or circulation of any pesticide that violates the conditions stipulated in Article 9. Article 12 sets forth the labeling rules for imported pesticide containers, permitting the confiscation of pesticides from circulation and use if these labels are incomplete or non-compliant. Article 14 specifies rules for storing pesticides in their original containers, which must not be opened or divided without administrative approval. Article 15 lists the conditions required for obtaining a license to trade agricultural pesticides for pest and disease control services. Article 17 details the types of pesticides forbidden for sale and prohibits licensed individuals from using, trading, or selling these pesticides to unlicensed individuals. Handling, transport, and use of these pesticides are restricted to licensed professionals. Acceptance of pesticide registration is based on confirming the experiments and studies conducted under local conditions, determining the pesticide's effectiveness and persistence in soil or crops, compliance with the country's needs, authorization for manufacture in the country of origin with the same composition and active ingredients, and ensuring the pesticide is not banned by the World Health Organization or environmental protection agencies in any country. Pesticides that are harmful to public health, prohibited, or non-compliant with these regulations must be seized, confiscated, and destroyed at the owner's expense. Licensed individuals are liable for damages resulting from negligence or error in pesticide use.
