Exploiting a secret quarry – misdemeanor of sand theft – criminalization – source of sand – public property.

The misdemeanor of sand theft has become criminalized pursuant to paragraph 3, Article 517 of the criminal code according to the amendment of the said text pursuant to law number 10.11 ordering the implementation of Dahir 1.11.152 on August 17.

In case of the availability of an administrative attestation that sand belongs to a public property as well as getting his preliminary confession confirming that the defendant extracted sand from public property and from a secret quarry with the help of others, the appealed decision when it based on the said confession was sufficiently explained.
