The court acquitted the defendant from minor offense of public pollution based on his denial, without discussing the observation made by judicial police which provides evidence about possession of harmful waste in his store in form of recyclable products, and without taking into consideration the declaration of the suspect himself in his hearing where he affirms collecting these waste and resell them without permit, and thus the court built its decision on an incomplete reasoning and subjected it to overruling.
