The court relied on the legal exmination conducted before the first instance court wich showed that the incidents resulted from a leakage of wastewater and resulted in different damages in the plants, wells and the house of the plaintiff. The court also based its decision on Article 77 of the Obligations and Contracts Code that set up the personal liability of the company as a legal person. however its decision does not harm what was stated in the first instance decision which arguments were independant and grounded.
