Abstract
This Law regulates basic rights and obligations of employees from the employment relationship, i.e. based on work, the manner and procedure of their realization, among issues regarding the collective agreement and the employment contract.
The text is divided into fifteen main thematic Chapters and a total of 219 articles. Titles of these Chapters are as follows: I. Basic provisions; II. Establishing of employment relationship; III. Rights and obligations of employees; IV. Protection of employees in case of bankruptcy proceedings; V. Protection of employees; VI. Protection of employees’ rights; VII. Responsibility of employees; VIII. Termination of employment; IX. Collective agreement; X. Employee and employer organizations; XI. Special types of contracts; XII. Workbook; XIII. Supervision; XIV. Penal provisions; and XV. Transitional and final provisions.
This Law applies: to employees who work on the territory of Montenegro for a domestic or foreign legal or natural person, as well as to employees who are sent to work abroad by an employer based in Montenegro, unless otherwise specified by a separate legislation; to employees in state bodies, state administration bodies, local self-government units and public services, unless otherwise specified by a separate legislation; to employed foreigners who work for an employer on the territory of Montenegro, unless otherwise specified by a separate legislation; to natural persons who engage in economic activity for the purpose of gaining profit, and do not perform this activity for the account of another. The expressions used in this law for natural persons in the masculine gender include the same expressions in the feminine gender. Direct and indirect discrimination of persons seeking employment, as well as employees, with regard to race, skin color, national affiliation, social or ethnic origin, connection with a minority nation or minority national community, language, religion or belief, political or other, is prohibited. opinion, gender, gender reassignment, gender identity, sexual orientation, health condition, disability, age, property status, marital or family status, pregnancy, group membership or assumption of group membership, political party, trade union or other organization, or any other personal property. An employment relationship is a relationship between an employee and an employer based on an employment contract, in accordance with the law and the collective agreement. Seasonal jobs are jobs that are performed in activities of a seasonal nature, such as agriculture, tourism, forestry and other activities, in which the performance of jobs is related to one period during the year, lasting no longer than eight months during the year (article 37, paragraph 9). Prohibition of discrimination, professional and sexual harassment are also regulated in this text (articles 7-14).
