Abstract
This Law regulates issues in the field of navigation on the sea and inland waters of the of Montenegro (once part of the former Socialist Federal Republic of Yugoslavia), which relate to: navigation safety, waterways, navigable and floating objects, including crew on the same, ports and docks, transport on the sea and inland waters and supervision over the execution of laws and other regulations in the field of maritime and inland navigation. Navigation safety includes the conditions that must be met on: waterways in the coastal sea and inland waters, ports and piers, anchorages, ships, boats and other navigable and floating objects, including the crew on them, navigation and pilotage.
The text is divided into ten main thematic Chapters and a total of 92 articles. Titles of these Chapters are as follows: I. Basic provisions; II. Waterways; III. Navigation facilities; IV. Ports and harbours; V. Transportation by sea and inland waterways; VI. Removal of sunken objects; VII. Supervision; VIII. Offence procedures; IX. Penalty measures; and X. Authorizations, transitional and final provisions.
This Law determines that on the sea and inland waterways, public transport of persons and things and transport of persons and things for own needs can be carried out. Also public transport can be carried out by organizations of associated work if they meet the prescribed conditions and if they register their activity in accordance with the applicable regulations. Working people can provide public transport through independent personal work with means owned by citizens in the manner and under the conditions prescribed by a special law. The supervision of the implementation of this Law and deriving regulations adopted on its basis shall be carried out by the harbor master's office. A waterway in the coastal sea and on inland waters is a strip in that sea and waters deep and wide enough for safe navigation, which is also marked if necessary. This Law classifies the navigation boats according to their purpose: boats/vessels/ships for commercial purposes (transportation of passengers and belongings for a fee, fishing, extraction of sand, gravel, etc.); boats for non-commercial purposes (leisure, sports, etc.); boats for administrative purposes (inspection, customs supervision, etc.). In article 46a it is declared that “the authorization for the entry of a foreign fishing vessel into internal sea waters is issued by the republican administrative body responsible for traffic affairs based on the previously obtained opinion of the republican administrative body responsible for internal affairs”.
